Constitutional Court judgment on Defamation

Section 31 (a) (iii) of the Criminal Law (Codification and  Reform Act), which criminalised defamation has been removed from the Statutes by the Constitutional Court. Defamation is no longer a criminal offence.

The section was dismissed as unjustifiable in a democratic society in a judgment delivered by the Deputy Chief Justice Luke Malaba. The court ruled that the law was in breach of freedom of expression as enshrined in the Constitution of Zimbabwe.
